Maps.com GEOGRAPHYINTHENEWS.COM™ PERMITTED USE AGREEMENT ALL PRODUCTS CONTAINED WITHIN GEOGRAPHYNEWS.COM™, HEREAFTER REFERRED TO AS GEOGRAPHY IN THE NEWS™ ARE COPYRIGHTED BY MAPS.COM, A CALIFORNIA CORPORATION (FORMERLY MAGELLAN GEOGRAPHIX) OR THIRD PARTIES. IT IS NECESSARY THAT YOU OBTAIN A LICENSE TO USE THEM. THE TERMS OF THE LICENSE ARE STATED BELOW. READ THESE TERMS. BY SUBSCRIBING TO GEOGRAPHY IN THE NEWS™, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. Each document and other material published by Maps.com on this server may contain other proprietary notices or describe products, services, or technologies owned by Maps.com or third parties. Nothing contained herein shall be construed as granting to the user a license under any copyright, trademark, patent or other intellectual property right of Maps.com or third party. This shall be a twelve (12) month license from date of signature below. UNDER THIS SCHOOL LICENSE YOU MAY: •Use content contained within GEOGRAPHY IN THE NEWS™ for school education purposes, including use in the classroom, library, laboratory or home activities of the subscriber school's students or teachers during the subscription period. •Use the content contained within GEOGRAPHY IN THE NEWS™ for the development of internal school documents, assignments, reports, or electronic presentations. •Use the GEOGRAPHY IN THE NEWS™ service on more than one computer at a time as long as you adhere to the above conditions. UNDER THIS SCHOOL LICENSE YOU MAY NOT: •Distribute the password or transfer digital content to others outside of the subscriber school's students and teachers. •Use any of the components in commercial products. •Use any of the components for creation of derivative software works. •Export GEOGRAPHY IN THE NEWS™ components, or any part thereof contrary to US export regulations. Due to the annual subscription structure of GEOGRAPHY IN THE NEWS™, use of GEOGRAPHY IN THE NEWS™, its components, documentation or any part thereof, is prohibited when the term of the subscription expires. All files obtained through GEOGRAPHY IN THE NEWS™ and its service must be erased from former subscriber(s) hard drive, desktop, and from any diskettes or software downloaded and created by subscriber(s). Continued use of GEOGRAPHY IN THE NEWS™ or its components or documentation, or any part thereof, is a violation of copyright laws. Use of services and components of GEOGRAPHY IN THE NEWS™ is strictly prohibited to anyone outside the registered subscriber and its students and teachers. EXCEPT AS SPECIFICALLY STATED IN THIS AGREEMENT, MAPS.COM MAKES NO WARRANTY OR REPRESENTATION, EXPRESS OR IMPLIED, REGARDING THE PRODUCT AND DISCLAIMS ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING SPECIFICALLY ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR THAT THE USE OF THE PRODUCT WILL OBTAIN ANY PARTICULAR RESULT. IN THE EVENT OF A FAILURE TO PROVIDE THE PRODUCT OR ANY DEFECT IN THE PRODUCT, THE SOLE REMEDY OF SUBSCRIBER AND USERS SHALL BE A REFUND OF THE AMOUNT PAID FOR THE SUBSCRIPTION TO THE PRODUCT (PRO RATED TO TAKE INTO ACCOUNT THE TIME THE PRODUCT WAS AVAILABLE). IN NO EVENT SHALL MAPS.COM LIABILITY EXCEED SUCH AMOUNT, EVEN IF MAPS.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL MAPS.COM BE RESPONSIBLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES ARISING OUT OF THIS AGREEMENT, OR THE PRODUCT (WHETHER THE CLAIMS IS BASED UPON BREACH OF CONTRACT, BREACH OF WARRANTY, STRICT LIABILITY, TORT OR OTHERWISE) INCLUDING, BUT NOT LIMITED TO LOSS OF USE, LOSS OF DATA OR INFORMATION OF ANY KIND, LOSS REVENUE OR LOSS OF PROFITS. Maps.com cannot guarantee that you will obtain the results you seek or warrant that the service will be error-free. We want to be sure that you are satisfied with the GEOGRAPHY IN THE NEWS™ on-line education resource service.
